By paying for and downloading any work published by FotoSul (Craig Rogers) you are agreeing to the following Terms & Conditions. Should you have any questions or concerns regarding these Terms & Conditions, please contact Craig Rogers before downloading your photographs or videos.
- 1: All photographs and videos remain the copyright of Craig Rogers (music and any additional 3rd party content remains the copyright of the creator), the instructing client will receive an exclusivity rights license*.
- 2: Payments to Craig Rogers cover the cost of travel, photography/videography time, post-processing time, storage, equipment and an exclusivity rights license* to use the resulting photography and videography for its original purpose. Please see point 3 for exceptions to public and shared private areas.
- 3: Photographs that show public and shared private areas captured during a shoot may be used by Craig Rogers for other clients. For example, but not limited to, Pool areas, gymnasiums, gardens, receptions. This scenario only occurs where it is difficult to capture new images of a particular location, for example, an indoor pool that is in constant use by residents. It is always the intention to capture new images on every shoot. However, if specific images are required and requested before the shoot, if possible to capture, these photographs will also be granted exclusivity rights* as described in point 2.
- 4: The turnaround timeframe from shoot to delivery is 1 week, however, is often 1 or 2 days. However, in certain situations, this may be increased due to demand, particularly after a period of inclement weather where demand is greater due to rescheduled shoots. This also includes the possibility of illness. However, my standard guarantee of delivery is 2 weeks from the date of shooting.
- 5: Payment is required before the final photographs are provided for download. Re-occurring clients may benefit from the final photographs being available for download before payment, in this instance, full payment is required strictly within 14 days of the shoot. Failure to pay could cause a legal requirement to remove all unpaid photographs from public use.
- 6: In the instance that Craig advises that the conditions are not adequate (normally, but not limited to, the weather) and a reschedule is offered, should the client insist to continue, Craig will strive to “make the best of a bad situation”. Should the final photographs not be acceptable, a re-shoot fee will be applicable and added to the original price.
- 7: Craig Rogers has a strict data backup procedure, however, in the unlikely event that shoot data is not useable for post-processing (includes, but not limited to; equipment malfunction, data corruption, lost data) it is the responsibility of Craig Rogers to provide the shoot again at no cost, in some cases (to be determined by Craig Rogers) the shoot may include a reduction or cancellation of the price of the shoot.
- 8: In the unlikely event that the client is not satisfied with the photography/videography produced and the weather and light conditions were acceptable, Craig Rogers may offer a free re-shoot.
- 9: Photographs and videos are supplied with the intention of the original reason and may not be used for any other purpose.
- 10: You are free to use and publish the photographs and videos in any form of display providing it meets the original purpose of requirement.
- 11: No photographs or videos are to be sold (excluding any costs passed onto clients including an increase to make profit).
- 12: Minor modifications to photographs and videos are permitted.
- 13: In the situation where the client instructing the shoot is different to the payer, it is the responsibility of the instructing client to offer the images to the payer. Unless authorised by the instructing client, Craig Rogers will not be able to supply copies to the payer. The client instructing the shoot will be the exclusivity rights licence* holder. For example, if a Real Estate Agent charges the client (directly or indirectly to Craig Rogers), the Real Estate Agent is the exclusivity rights licence* holder.
- 14: Original, unprocessed (otherwise known as “RAW”) photographs and videos are retained for a period of 12 months from the date of shooting. After this period they are deleted from storage. Further retention is available at an additional yearly cost, please contact Craig Rogers for pricing.
- 15: Final published photographs and videos are retained for a period of 12 months from the date of shooting. After this period they are deleted from storage. Further retention is available at an additional yearly cost, please contact Craig Rogers for pricing. It is advised to download the photographs and videos and securely store them.
- 16: Final published photographs and videos are available to download from the personal portfolio page for 12 months and are removed as per the above retention policy.
- 17: Original, unprocessed (otherwise known as “RAW”) photographs and videos are not available, due to my personal method of shooting, the files are not shared. Individual clips from processed videos can be made available, these clips retain their post-processing work.
- 18: Craig Rogers reserves the right to use any photograph or video for his own purpose, including but not restricted to advertising, social media and printed materials.
- 19: Craig Rogers will never provide client details to any 3rd party unless specifically requested by the client. For example, but not limited to, client details will never be given to Real Estate Agents unless requested by the client.
*Exclusivity rights license: Craig Rogers retains the copyright of any images (still and video) but an exclusivity rights licence deems that the imagery is available for the instructing client to use for their own purposes. These images are not available to be used by any other 3rd party unless specifically requested by the client that holds the exclusivity rights licence.
